Welcome to StudioRDesigns.com, operated by Refitified, LLC d.b.a. Studio R (“Studio R,” “we,” “our,” or “us”). Studio R provides integrated marketing solutions, including fusion photography, 3D model scanning, stabilized video, floor plan creation, online virtual tours, property websites, ePrint platforms, and printed marketing materials (collectively, the “Services”). 

By using Studio R's Services, you agree to these terms and conditions (the “Terms of Use”) and confirm that you have read and accepted the following provisions. 

Any written agreement between you and Studio R regarding Services (“Services Agreement”) shall incorporate these Terms of Use.

The Subject Property :

You represent that you are the owner or authorized agent of the property related to the Services provided by Studio R. You acknowledge that both you and the property owner are bound by these Terms of Use.  

Cancellations, Rescheduling, & Weather:

Any changes or cancellations made less than 24 hours prior to your scheduled booking will incur a fee equivalent to 25% of the initial shoot cost. It is your responsibility to ensure the property is ready for the photography shoot (please see our FAQs on our website for a detailed prep guide).  

Our videographers will make every reasonable effort to accommodate client-related delays. However, if they determine that extended wait times may interfere with their subsequent appointments, they reserve the right to depart the property in order to honor their scheduled commitments.

Weather-related rescheduling must be confirmed at least 2 hours before the appointment start time. We do offer sky replacement editing for gloomy skies if it’s not actively raining. Our team will contact you the morning of the shoot to coordinate options should the whether prevent safe travel of our videographers. 

Any cancellations made prior to the 24hrs cutoff point, and delays caused circumstances that could not be controlled resulting in the cancellation of a shoot will be subject to refund if deemed such by our management team, but will still incur a 3% processing fee to cover third-party transaction costs. 

Payments:

Unless otherwise specified in a Retainer Agreement, payment is due in full at the time of scheduling a photography shoot. Full payment constitutes acceptance of these Terms of Use. You and any party you represent are jointly responsible for full payment.  

Turnaround Times:

All photos have a 48 hour delivery SLA. Listing videos have a slightly longer SLA. We aim to deliver listing videos within 2-3 business days, depending on editing needs. For any customer edits or special projects, turnaround times may vary. Floor plans and 3D tours are not produced in-house; if ordered, they are typically delivered within 48 hours by our 3rd party provider. We are not responsible for third-party-related delays as we have no control over their pipelines.

Refund Policy:

If clients do not receive their content in 14 business days via dropbox link or monday.com they will receive a full refund. Clients subscriptions are on a month to month basis and can be cancelled with a 30 day notice. Client subscriptions abide by a separate Retainer Agreement.

Grant of Rights in the Property:

You grant Studio R a non-exclusive, perpetual, royalty-free right to use, create, reproduce, display, and distribute any intellectual property rights in the property for providing the Services.

Ownership of Work Product:

Studio R owns all rights to the Work Product developed in connection with the Services. You are granted a limited, non-transferable license to use the Work Product for marketing purposes related to your property listings.  

Social Media Content Usage:

We may feature content on Studio R’s social platforms unless otherwise requested. If you'd like to delay or opt out of social sharing, please inform us before your shoot.

Media Hosting:

Studio R provides media hosting for up to 6 months. After 6 months, additional fees may apply. You may retrieve media before the 6-month period ends, but additional storage fees may be incurred for extended hosting.

Deliverable Edits/Reviews:

To ensure timely delivery and efficient resource allocation, clients must provide any requested edit notes, revisions, or feedback within fourteen (14) calendar days from the date of initial deliverable delivery. If no feedback is received within this period, Studio R’s editors will close the project file and move on to other assignments. Any edits requested after the 14-day period may be treated as a new project and subject to additional fees.

Representations and Warranties:

You represent that you have obtained all necessary consents and permissions to grant rights to Studio R for the use of the property in the Services.

Disclaimer of Warranties:

Studio R provides the Services on an “as is” basis without warranty of any kind. Some jurisdictions may limit or not allow the disclaimer of warranties, in which case the above disclaimers may not apply to you. 

Limitation on Liability:

Studio R shall not be liable for any direct, indirect, or consequential damages arising from the use of the Services.

Indemnification:

You agree to defend, indemnify, and hold harmless Studio R from any claims or liabilities arising from your breach of these Terms of Use or your use of the Services.

Feedback:

Any suggestions or feedback provided by you to Studio R may be used by Studio R without obligation.

Class Action Waiver:

All arbitration shall be conducted on an individual basis. Class actions are not permitted.

Arbitration Opt-Out:

You may opt out of arbitration by notifying Studio R in writing within 30 days of registering for the Services.

Governing Law and Venue:

These Terms of Use shall be governed by the laws of Washington, DC, Maryland, or Virginia, and any litigation shall be conducted in courts located within these jurisdictions.

Entire Agreement:

These Terms of Use, along with the Retainer Agreement, if you are a retainer client, constitute the entire agreement between you and Studio R regarding your use of the Services.

Severability:

If any provision of these Terms of Use is deemed unlawful, it will not affect the validity of the remaining provisions.

Waiver :

Failure to enforce any rights under these Terms of Use does not constitute a waiver of such rights.

Assignability:

You may not assign these Terms of Use to any third party without the prior written consent of Studio R.
